Return Policy

1. General 15-Day Return Period

1.1. Eligibility Period

Customers may return items for any reason within fifteen (15) days from the date the shipping carrier records the item as delivered.

1.2. Condition of Returned Items

To qualify for a return, the item must be in its original, undamaged condition, with no signs of misuse, alteration, or customer-caused damage. Items that are broken, chipped, scratched, stained, or otherwise damaged due to customer handling are not eligible for return or refund.

1.3. Return Shipping Costs

All return shipping costs are the sole responsibility of the purchaser. Original shipping charges are non‑refundable.

2. Damaged or Defective Items on Arrival

2.1. Reporting Timeframe

If an item arrives damaged or defective, the purchaser must notify Rose Under Glass LLC within five (5) days from the date the shipping carrier records the package as delivered.

2.2. Required Documentation

When reporting damage, the purchaser may be required to provide:

Clear photos of the item, packaging, and shipping label; and
A brief description of the damage or issue.

Failure to report damage within the specified 5-day period may result in the claim being denied.

3. Refunds, Replacements, and Company Discretion

3.1. Inspection of Returns

All returned items are subject to inspection. If the item is found to be damaged due to customer handling, no refund or replacement will be issued, and the item may be returned to the purchaser at their expense.

3.2. Refunds and Replacements

If a return is approved, Rose Under Glass LLC may, at its sole discretion:

Issue a refund of the item's purchase price, minus any shipping charges, in lieu of requiring the item to be returned; or
Require the item to be returned and, upon receipt and inspection, either issue a refund of the item's purchase price (excluding shipping) or send a replacement item of equal value, if available.

3.3. Non-Refundable Shipping

Original shipping costs are non‑refundable under all circumstances.

4. Force Majeure

Rose Under Glass LLC shall not be liable for any delay or failure in performance, including but not limited to delays in shipping, delivery, communication, or processing returns, to the extent caused by events beyond its reasonable control, including but not limited to:

Acts of God;
Natural disasters (such as floods, fires, earthquakes, storms);
War, terrorism, civil unrest, or acts of public enemies;
Governmental actions, orders, laws, or regulations;
Epidemics, pandemics, public health emergencies;
Labor disputes, strikes, lockouts;
Failures or disruptions of transportation, utilities, communications, or supply chains.

In such cases, the time for performance shall be extended for a period reasonably necessary to overcome the impact of the force majeure event.

5. Governing Law and Venue

This policy, and any dispute arising out of or relating to purchases from Rose Under Glass LLC, shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict‑of‑law principles.

The agreed venue for any permitted court proceedings (as limited by the arbitration provision below) shall be in the State of Illinois.

6. Arbitration Agreement

6.1. Agreement to Arbitrate

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to any purchase from Rose Under Glass LLC, this return and refund policy, or any related transaction or communication shall be resolved by binding arbitration, rather than litigation in court, except that either party may bring an individual claim in small claims court if it qualifies.

6.2. Arbitration Rules and Forum

Arbitration shall be conducted by a recognized arbitration provider and under its applicable rules for consumer disputes. The arbitration shall take place in Illinois, unless both parties agree otherwise, and may be conducted by video or teleconference where allowed.

6.3. Individual Claims Only

Arbitration shall be conducted on an individual basis. Class actions, class arbitrations, or representative actions are not permitted.

6.4. Severability

If any portion of this arbitration agreement is found unenforceable, the remaining portions shall remain in full force and effect, except that if the prohibition on class or representative actions is found unenforceable, the entire arbitration agreement shall be void as to such claims.

7. Policy Changes

Rose Under Glass LLC reserves the right to modify or update this return and refund policy at any time. Any changes will apply to purchases made after the effective date of the updated policy.
